PunchDesk

Terms of Service

Version 2026-10-13

Draft. These terms have not yet been reviewed by a lawyer. They describe what PunchDesk does today, honestly and narrowly. Do not rely on them as a final agreement.

1. Who this is between

These terms are between the company that creates a workspace (“you”) and the operator of PunchDesk (“we”). The person who signs up confirms they are authorised to accept them on the company’s behalf.

TO BE SETTLED: the operator’s legal entity name, registered address, GSTIN and CIN.

2. What the service is

PunchDesk records staff attendance from a phone using GPS and a face check, and turns that attendance into leave, overtime and a monthly payroll run with Indian statutory deductions. You can read what it does and does not do on the product pages; nothing is promised here that the app does not do today.

3. Your data, and our role in it

Your workspace holds personal data about your employees — names, salaries, identification numbers, photographs, location at the moment of a punch, and face templates used to verify identity. You are the data fiduciary for that data. We process it on your instructions in order to run the service.

We do not sell it, do not use it to train anything, and do not use it for any purpose other than operating PunchDesk for you. How we handle it is set out in the Privacy Policy, which forms part of these terms.

Face data. Face templates are biometric data. An employee may ask you to delete theirs at any time, and attendance then relies on a selfie reviewed by your HR. Face data is deleted when an employee leaves.

TO BE SETTLED: whether a separate signed Data Processing Agreement is required alongside these terms, the sub-processor list (hosting, email, push notifications, file storage), and the breach-notification window.

4. Deleting your data

You can delete your own account in the app at any time. If you are the last administrator of your workspace, that deletes the entire workspace and everything in it, including stored files. This cannot be undone and we cannot recover it afterwards.

5. Trial, fees and cancellation

A new workspace starts on a free trial. Nothing is locked when the trial ends.

TO BE SETTLED: price, billing period, what happens when payment fails, notice period for cancellation, refund policy, and whether fees are exclusive of GST. No money can be taken until this section is real.

6. Availability

We aim to keep the service available but do not currently offer a contractual uptime guarantee. If that changes it will be stated here, with the measurement and the remedy.

7. Liability

TO BE SETTLED — a lawyer must write this. It is the section a buyer’s legal team will read first, and a borrowed clause is worse than none.

8. Changes to these terms

If we change these terms we will publish the new version here with a new version number. We record which version your company accepted and when.

9. Governing law

TO BE SETTLED: governing law and the courts with jurisdiction.
